SECTION 25

GENERAL

A.    Assumption of Agreement

The Company agrees that if it disposes of its operations as a whole, it shall require the acquiring corporation to assume this contract and the Union hereby agrees that such corporation may be substituted for the Company.

B.    Name Change

A court order or marriage certificate must be submitted to the Company before a Flight Attendant's request for a name change is processed.

C.    Flight Attendant Facilities at Base Stations

1.    Lounges

The Company shall provide suitable, furnished lounges for the exclusive use of Flight Attendants at all Flight Attendant base stations. In the event that the Company establishes new bases for Flight Attendants, lounge facilities shall be provided within a reasonable period of time. All base station lounges shall be furnished with couches or reclining lounge chairs.

2.    Luggage Storage, Telephones and Computer Terminals

a.    The Company shall provide luggage storage, telephones and computers within close proximity to lounge locations.

b.    At the Seattle base the present luggage space on the main level of the airport is acceptable.

c.    A minimum of three (3) computer terminals for CENTRY/PBS use shall be available at LGA for Flight Attendants. A minimum of two (2) computer terminals for CENTRY/PBS use shall be available at EWR for Flight Attendants.

3.    Quiet Lounges

In MSP, DTW and any other base of two thousand (2,000) or more Flight Attendants there shall be a quiet lounge. All quiet lounges shall be furnished with couches and/or reclining lounge chairs. Such lounges shall have separate entry doors and be quiet rest areas and shall be for the exclusive use of Flight Attendants. They shall not have telephones or computers.

4.    Present Base Facilities

In MSP and any other location agreed to by the MEC President, or his/her designee, the Company may create a larger and more spacious lounge for the exclusive use of all flight crew members in lieu of the Flight Attendant lounge(s) referenced in subparagraph C.1., above.

NOTE: Current Flight Attendant lounge, computer and luggage stowage facilities are acceptable. However, the Company agrees to meet and confer with the MEC President, or his/her designee, to mutually discuss and explore options to improve the Inflight facilities at JFK, LGA and EWR.

D.   Foreign Service Bonus and Station Allowance

All Flight Attendants who are based outside of the forty-eight (48) contiguous states of the United States and the state of Hawaii shall receive a foreign service bonus and station allowance in accordance with the Company's policy which shall not be less than allowed other personnel at the same base.

NOTE: The Company and the Union shall meet and confer at least one hundred and twenty (120) days prior to the opening of a new foreign base station to agree upon a foreign service bonus and station allowance.

E.    Death Downline

In the event a Flight Attendant dies while on Company business away from his/her base station, the Company shall return the Flight Attendant's remains to his/her base or station closest to the place of burial, without transportation cost to the Flight Attendant's estate.

F.    Mailboxes

1.    The Company shall provide a mailbox for each Flight Attendant at his/her base.

2.    The Company shall provide a mailbox for each NYC based Flight Attendant at one (1) of the three (3) co-terminals (either JFK, LGA or EWR) at the Flight Attendant’s option. Flight Attendants may make such election every three (3) months. The type of mailbox provided shall be at Company option.

G.   Paychecks and Monthly Crew Member Activity Statements (CMAS)

Flight Attendants shall be paid on the thirteenth (13th) and twenty-seventh (27th) of each month unless otherwise agreed to by the Company and the Union. Crew Member Activity Statements shall be included with the check on the thirteenth (13th).

1.    First Half Check (27th Check)

The check of the twenty-seventh (27th) is also called the “first half check” or the “first half advance”. This check is half (1/2) of the Flight Attendant’s base pay. Any leave time during the month may cause this check to be reduced. This check may also contain adjustments for a prior month.

2.    Month End Settlement Check (13th Check)

The check on the thirteenth (13th) is also called the “month end settlement check”. This check calculates the earnings for the entire preceding month consisting of base pay, incentive pay, Lead Flight Attendant pay, Purser pay, international flying pay, per diem, standby pay, training pay and any other applicable premium pay. From this total, the first (1st) half advance is subtracted.

3.    Monthly Crew Member Activity Statement (CMAS)

The monthly Crew Member Activity Statement shall include, but not be limited to: vacation year-to-date accrual, sick leave accrual totals, per diem hours, international flying pay, Lead Flight Attendant pay, Purser pay, itemized actual flight time for each flight segment, crew complement, passenger count, aircraft type, departure and arrival times.

4.    Payroll Errors

Should an error be made in the computation of a Flight Attendant's pay which involves more than fifty dollars ($50.00), payment shall be made not later than five (5) calendar days following confirmation.

5.    Direct Deposits of Paychecks

Upon request, the Company shall direct deposit the Flight Attendant’s paycheck(s) to the financial institution of his/her choice. At the Flight Attendants option, the Company shall mail his/her paycheck(s) to his/her address on file, at his/her expense.

H.   Extra Flight Attendant (XFA) Seats

XFA ("Extra Flight Attendant") seats (also known as Flight Attendant jump seats) on all Company aircraft shall be made available for Flight Attendants on personal travel. All Flight Attendant employees of the Company shall have priority over non-Flight Attendant employees of the Company who are on personal travel.

1.    The Company shall provide a toll free telephone number for Flight Attendants who wish to list themselves for available XFA seats. Such ability to list shall also be available through ATLAS. Such listings shall become available ten and one half days (10 1/2) prior to flight departure time. One (1) XFA listing on narrow body aircraft and two (2) XFA listings on wide body aircraft may be made in advance.

2.    Beginning at one hour (1:00) prior to scheduled departure of a flight that operates solely within the fifty (50) Unites States, if an XFA seat is still available, it shall be booked to Flight Attendants and other eligible persons on a first come, first served basis.

3.    Flight Attendants who have listed for an XFA seat who do not arrive at the gate thirty minutes (0:30) prior to departure of a flight that operates wholly within the fifty (50) United States, or one hour and thirty minutes (1:30) prior to the departure of a flight that does not operate wholly within the fifty (50) United States shall lose their reserved listing and the XFA seat(s) shall be awarded as follows:

a.    On flights that operate wholly within the fifty (50) United States, on a first come, first served basis. If the agent is unable to determine which of two (2) or more Flight Attendants arrived at the gate first, the jump seat shall be offered to such Flight Attendants in seniority order.

b.    On flights that do not operate wholly within the fifty (50) United States, to the next Flight Attendant who is listed via the automated listing process as provided for in subparagraph H.1., above. Such list shall close at one hour (1:00) prior to scheduled departure.

4.    Flight Attendants who occupy an XFA seat may take an open passenger seat once the boarding door is closed.

5.    A Flight Attendant may list as both a non-revenue passenger and XFA seat rider on the same flight.

I.   Pass Travel

The Company shall not substantially diminish the benefits provided by the Company's Pass and Reduced Rate Transportation Policy, as it exists on the date of signing of this Agreement. The Company reserves the right to make reasonable increases in the service charge for such benefits. Flight Attendants shall be eligible for the full benefits of such policy effective from the date they are first assigned to active service as a Flight Attendant.

J.   Employee Parking

The Company shall provide, at no cost to the Flight Attendant, a parking space at his/her base station. In lieu thereof, subject to space availability, a Flight Attendant may opt to hold a parking space at another base station, provided that the added cost of such alternate parking space, if any, shall be borne by the Flight Attendant.

NOTE: The Company shall maintain a number of parking spaces appropriate for its operations at JFK, LGA and EWR for use by New York based Flight Attendants when operating a pattern out of one (1) of those terminals. The Company agrees to meet and confer with the MEC President, or his/her designee, prior to changing parking locations or changing the number of parking spaces available for Flight Attendant use in JFK, LGA or EWR.

K.   Inflight Sales Revenue Deposits

1.    The Company, at its discretion, shall collect Inflight sales revenue via:

a.    Drop safe deposits;

b.    Deposits with a designated representative(s) of the Company; or

c.    A combination of a. and b., above.

2.    Inflight Sales Revenue Deposit Procedures – General

a.    Flight Attendants who complete patterns terminating at their base stations must deposit their Inflight sales revenues and receipts with a designated Company representative or in a designated drop safe before leaving the airport.

b.    At its option, the Company may install drop safes and/or designate Company representatives to collect Inflight sales revenues and receipts at the terminal at non-Inflight base stations.

3.    Drop Safe Deposit Procedures

When Flight Attendants are required to deposit Inflight sales in a drop safe, the following procedures shall apply:

a.    Two (2) designated Company representatives shall verify which deposits were retrieved from the drop safe;

b.    A receipt verifying the deposit shall be placed in each Flight Attendant’s Company mailbox within fourteen (14) days of receipt;

c.    In the event of a dispute between the Company and a Flight Attendant regarding the amount deposited in a drop safe, the Flight Attendant shall not be held responsible for any claimed shortages in the first (1st) instance of such a dispute;

d.    Drop safes shall be designed and constructed to protect the security of all deposits;
                                                                            
e.    Drop safes shall be located in secured areas;

f.     The Company shall consult with the MEC President, or his/her designee, prior to selecting additional drop safe locations within the system effective after the date of signing of this Agreement.

4. Inflight sales collection facilities shall be available at JFK, LGA and EWR.
