UNION ACTIVITIES
A. Distribution Of Agreement
The Company shall provide each Flight Attendant with a copy of this Agreement printed in a convenient booklet within sixty (60) days of the Union's delivery of a completed index to the Company following the signing of this Agreement. While such printed copies are intended to reflect all applicable provisions of this Agreement, the governing provisions are those contained in the original executed basic agreements and the executed amendments thereto. The booklet's cover, print size and paper quality shall be subject to mutual agreement. In the event a Letter(s) of Agreement is signed after the distribution of such booklet the Company and the Union shall agree upon the sequential number of the Letter of Agreement and the Company shall then provide such Letter of Agreement to each Flight Attendant within thirty (30) days of execution.
B. Bulletin Boards
Suitable bulletin board space shall be made available at each base station and co-terminal for posting notices of Union social and recreational affairs, Union elections, results of Union elections, Union meetings and notices pertaining to the administration of this Agreement. There shall be no other general distribution or posting by Flight Attendants or the Union except as provided in this section. At the option of the Union, the Company provided bulletin board space may be filled by a locked and enclosed bulletin board purchased by the Union and installed at the Company's expense, the design of which shall be subject to Company approval and the size of which shall not exceed five (5) feet by four (4) feet. If this option is selected, the Company shall be provided a key to the bulletin board's lock.
C. Locked Union Boxes
The Company shall provide space at each base station for the Union to provide, at its own expense, a locked box for the purpose of receiving correspondence from Flight Attendants. If additional space is available at a base, at no expense to the Company, the Union may provide, at its own expense, more than one (1) locked box for the purpose of receiving correspondence from Flight Attendants.
D. Union Bulletin Binders
The Company shall provide space at each base station for the Union to provide, at its own expense, binders for the purpose of providing Flight Attendants with access to Union bulletins and notices. The content of documents placed in the binder shall be limited to the subjects as provided in paragraph B., above.
E. Access to Flight Attendant Mailboxes
The Union shall be granted access to Flight Attendant mailboxes for distribution of Union material as follows:
1. Prior to distribution of material, the Union must provide copies to the respective Base Manager and the Vice President Labor Relations, or their designees.2. Items considered acceptable for distribution shall be limited to official Union publications. Publications considered to be unacceptable include, but are not limited to, publications containing:
a. Items which contain personal attacks or derogatory statements;
b. Items not related to Northwest Airlines, Union activities or the Flight Attendant position; for example, advertisements or solicitations; or
c. Items related to political campaigns, including those related to Union politics with the exception of official Union notices announcing internal Union elections or Union election results.
3. The Company shall retain the right to revoke access in the event it deems the privilege has been abused.
F. Access to Flight Attendant Training Classes
1. The Union shall have access to Flight Attendant Initial Training classes for a one hour (1:00) presentation at a time mutually agreeable to the Union and Inflight Services Training.
The Company shall advise the Union of the dates and times within seven (7) days of requalification classes held for Flight Attendants recalled from furlough. If available at no cost to either party, the Company shall also provide the Union with a room for the purposes of meeting with the recalled Flight Attendants, at the Flight Attendants’ option, for thirty minutes (0:30) prior to the beginning of the requalification class. Such meeting time shall not be counted as classroom time for pay purposes or towards the length of the training day.
G. Distribution and Access to Information
1. The Company shall provide to the MEC President and to each LEC President a monthly list(s), via electronic mail, of:
a. Base transfers
b. Name changes
c. Terminations
d. Resignations
e. New hires
f. Furloughs
g. Recalls
h. Temporary assignments
i. Temporary vacancies
j. A list of all Flight Attendants who are on special assignment, including the nature and duration of such special assignment(s)
2. The Company shall provide to each LEC President at each base, via electronic mail, the following:
a. A monthly copy of the most current Flight Attendant System Seniority list including each Flight Attendant’s mailing address and primary telephone contact number as entered in the Company’s ACCESS system or the designated automated system
b. A copy of each month's analysis for the basec. A copy of all bid results for the base
d. A copy of each informational bulletin issued to all Flight Attendants at the base
e. Upon request, a list of the total monthly flight time hours for each Flight Attendant
H. Access to NWA Computer Systems
1. The Company shall provide access to the Company’s computer systems to the MEC Officers, LEC Officers, MEC Grievance Committee Chairperson(s), MEC Employee Assistance Program (EAP) Chairperson and MEC Scheduling Committee Chairperson as follows:
a. Maintain their personal Flight Attendant level access to ACCESS, ATLAS, CENTRY and RADAR; and
b. Provide current Union level “read only” access to CMS.
2. Should the Company upgrade or change its designated automated systems (i.e., ACCESS, ATLAS, CENTRY, CMS and RADAR) equivalent access shall be granted to the designated parties.
I. Union Flight Pay Loss Account / Flight Loss Pay / Flight Pay Continuance
1. Union Flight Pay Loss Account
The Company shall credit the Union Flight Pay Loss Account in the amount of one hundred and fifty thousand dollars ($150,000.00) on the first (1st) day of July, following ratification and on each succeeding July 1st thereafter during the term of this Agreement, subject to the terms below.
2. Flight Pay Loss (FPL)When a Flight Attendant is on official Union business leave, he/she shall be paid flight pay loss for the trip(s) dropped when such leave has been authorized by the MEC President, or his/her designee. The following shall apply:
a. Effective January 1, 2009, as part of the flight pay loss, the Company shall include the international override pay for international trip(s) dropped.
b. The Company shall be reimbursed by the Union for such actual pay plus twenty-eight percent (28%) of such amount for salary related costs incurred.
c. The Company shall use a direct billing procedure for reimbursement from the Union for flight pay and salary related costs. It is expected that the Union shall make reimbursement in full and return its payment to the Credit Division not later than fifteen (15) days after receipt of the Company’s billing.
d. However, should thirty (30) days from the date of the Company’s billing pass without reimbursement from the Union, and should reimbursement appear to be in jeopardy, the Company may deduct the flight pay loss and override from dues collected pursuant to payroll deduction forms as provided for in Section 24.B.1. of this Agreement.
3. Paid and Unpaid Union Leave Codes
A trip dropped due to Union business may be coded:
a. “UB” which allows the Flight Attendants to be paid flight pay loss for the trip and receive credit hours for which the Union shall be billed, or
b. “UL” which shall result in no pay or credit allowing the Flight Attendant to receive pay for hours flown and credited for the remainder of the month. The “UL” Flight Attendant may bid for leave make up as a Category 11.
NOTE: This election must be communicated to Crew Scheduling by the Union, not the Flight Attendant, at the time the trip drop request is made.
4. Pay Continuance for Flight Attendants on Union Leave (FPC)
a. Flight Attendants on full-time Union leave shall receive the following Flight Pay Continuance (FPC) on a monthly basis:
(1) Ninety-two hours (92:00) of flight pay at the applicable rate set forth in Section 3 of the Flight Attendant Collective Bargaining Agreement;
(2) Effective January 1, 2009, ninety-two hours (92:00) of international flying pay; and
(3) Ninety-two hours (92:00) of Lead Flight Attendant pay at the wide body rate.
b. Payment shall be the thirteenth (13th) and twenty-seventh (27th) of each month.
c. On a monthly basis, the Company shall submit a Flight Pay Continuance Payroll Invoice to the MEC President, or his/her designee, for payment upon receipt. The invoice shall list each employee by employee number and shall include the total payment made to each employee, including tax withholding.
d. Flight Attendants on Flight Pay Continuance shall not receive monthly vacation and sick leave accruals but shall continue to receive benefit accrual service credit as provided in the Retirement Plan Agreement and may elect to make contributions to the Northwest Airlines Retirement Savings Plan on the same basis as Flight Attendants on active status.
e. The Union shall pay the applicable premium(s) required to provide medical, dental and life insurance benefits under the Company Plan as outlined in Section 29 of this Agreement.
J. Company Assistance in Negotiating Leases
The Company shall assist the Union in negotiating leases for available space for offices at any Flight Attendant base station.
K. Union Pass Travel Authority
The Company shall provide positive space Y1/F2 service charged waived passes for all elected Union Representatives who are employed by the Company and are traveling for Company business purposes. Union business travel shall be at F2U priority with service charge or Y2U with service charge waived. This provision shall not affect the pass travel rights of Union officers who are Company employees and are issued travel authority cards.
